A component of the building regulations concerns the eaves height. In some building areas it is fixed by definition, in others there is a certain amount of leeway. What is the eaves right?

The eaves right, also called roof right, is regulated in the state neighbor law law. It contains specifications for the drainage of rainwater on your own property so that neighboring properties are not affected. The term eaves right is misleading because it is a duty that homeowners must fulfill, not a right.

The eaves right plays a central role at the property boundary, because it determines whether and under what conditions water may drip off outside the property. There are three different scenarios:

  • neighboring green areas and bodies of water
  • neighboring public areas
  • neighboring residential lots

The roof pitch and ridge height are key dimensions that must be taken into account when planning the house. The ridge height - that is the distance between the ridge (upper edge of the roof) and the ground - is also often specified in development plans. The roof pitch also has an influence on the dimension for the eaves height. An example for explanation: With a roof pitch of 30 degrees, the eaves height in a building area is around 3.5 meters, for example. With a roof pitch of 22 degrees, the height of the eaves is, for example, four meters.
