Which regulations apply to the height of the eaves?
In the vast majority of municipalities, a local development plan regulates the details of the permitted construction method. There are few exceptions. A component of the building regulations concerns the eaves height. In some building areas it is fixed by definition, in others there is a certain amount of leeway. There, the information provides for a minimum and a maximum height.
What is the eaves point?
The eaves point is the intersection of the facade and the roof skin. Roofs usually protrude beyond a wall and form what is known as the roof overhang. The front edge of the roof is the eaves. The intersection of the roof and the wall is called the eaves point.
How do you determine the dimensions of the eaves height?
The eaves height is first determined graphically or by calculation. A reference point is required for this, which usually results from the upper edge of the adjacent public road. There are alternatives to street height that can also be used to define a reference point:
- Intersection between rafters, outer wall and street level
- Height of rafters or roof cladding
Starting from the reference point, the eaves height specified in the development plan is measured upwards.
What is the eaves right?
The eaves right, also called roof right, is regulated in the state neighbor law law. It contains specifications for the drainage of rainwater on your own property so that neighboring properties are not affected. The term eaves right is misleading because it is a duty that homeowners must fulfill, not a right.
The eaves right plays a central role at the property boundary, because it determines whether and under what conditions water may drip off outside the property. There are three different scenarios:
- neighboring green areas and bodies of water
- neighboring public areas
- neighboring residential lots
Tip: Please inform yourself in the course of planning about the applicable eaves law or speak to your architect. If the eaves law is disregarded, the building application may be rejected.
